Preamble  

Work and Pay operates a transportation platform in Lomé as part of a project to launch a fleet of cars. These General Terms and Conditions of Sale (GTC) govern:  

• The transportation services offered to customers via a mobile application  

• The registration conditions for drivers in the “Work and Pay” program (2-3 year contract to become a car owner).

Article 1: Purpose  

These GTC define the terms and conditions applicable:  

• To customers using transportation services (car rides in Lomé).  

• To drivers participating in the “Work and Pay” program (acquisition of a car through weekly payments).  

These GTC comply with Togolese law, including the Commercial Code and OHADA provisions.

 

Article 2: Transportation Services  

2.1. Description  

Work and Pay offers urban transportation services in Lomé via a fleet of compact cars (e.g., Toyota Corolla), managed by a dedicated supervisor. Rides are booked through a mobile application, ensuring safety, reliability, and accessibility.

 

2.2. Booking Terms  

• Customers book a ride via the application  

• Required information includes: starting point, destination, and preferred time.  

• Bookings are subject to driver availability

 

2.3. Pricing  

• Ride prices are calculated based on distance, time, and traffic conditions in Lomé.  

• Fares are displayed in the application before ride confirmation.  

• Payment methods: Mobile Money (e.g., Flooz, TMoney), bank card, or cash.

 

Article 3: “Work and Pay” Program for Drivers  

3.1. Description  

The “Work and Pay” program allows drivers to become car owners in 2-3 years through weekly payments, while operating rides via the platform.

 

3.2. Registration Conditions  

• Eligibility: Minimum age 21, valid driver’s license, driving experience (preferred), and submission of an application via the website.  

• Training: Mandatory, covering traffic regulations, safety, and use of the application.  

• Commitment: Signing a “Work and Pay” contract

 

3.3. Financial Terms  

• Payments: Weekly installments deducted from generated income  

• Ownership: At the end of the contract, subject to full payment, car ownership is transferred to the driver.  

• Insurance and maintenance: Covered by Work and Pay for the first year

 

3.4. Driver Obligations  

• Make weekly payments on time.  

• Keep the car in good condition (monitored by the supervisor).  

• Meet service standards (safety, punctuality).  

• In case of non-compliance (e.g., missed payments), Work and Pay may terminate the contract and repossess the car.

 

Article 4: Responsibilities  

4.1. Work and Pay  

• Provide reliable cars that meet Togolese standards.  

• Ensure driver training  

• Guarantee technical support via the application and supervisor  

• Maintain confidentiality of customer and driver data (see Privacy Policy).

 

4.2. Customers  

• Provide accurate information when booking.  

• Respect drivers and terms of use (e.g., no disruptive behavior).  

• Make payments on time.

 

4.3. Drivers  

• Comply with the terms of the “Work and Pay” contract.  

• Provide quality service to customers.  

• Report any issues (e.g., breakdown) to the supervisor.

 

Article 5: Cancellation and Refund  

• Drivers: In case of early termination of the “Work and Pay” contract (e.g., non-payment), no refund of payments will be made. Amounts paid are considered usage fees.

 

Article 6: Limitation of Liability  

Work and Pay cannot be held liable:  

• For damages caused by improper use of the application by customers.  

• For unexpected car breakdowns if due to driver negligence.  

• For service interruptions due to force majeure (e.g., strikes, natural disasters).

 

Article 7: Governing Law and Disputes  

• These GTC are governed by the Togolese Commercial Code and OHADA provisions.  

• Any dispute will be submitted to the competent courts of Lomé.  

• In case of disagreement, the parties agree to attempt an amicable resolution before any legal action.

 

Article 8: Amendments to the GTC  

Work and Pay may amend these GTC to reflect project developments or regulatory changes. Amendments will be published on the website with an update date.
